Terms & Conditions of Use

These Terms & Conditions (“Terms”) create a legally binding agreement between you (“you” / “your”) and the relevant Oto entity named below (“Oto”, “we”, “us”). By downloading our mobile application, creating an account or otherwise using the service (the “App”), you agree to these Terms.
1 Who you contract with

2 Important health disclaimer
The App is a self-guided programme that may help users manage tinnitus symptoms and live well with their diagnosed condition. The App has not been evaluated or cleared by the US Food & Drug Administration (FDA) or any equivalent regulator. The FDA presently exercises enforcement discretion for certain low-risk self-management software functions.
Not for emergencies. Do not use the App in a crisis, if you feel suicidal or if you require urgent medical care. Call the emergency services immediately.
Users are directed not to change any prescribed medication or other medical treatment without first seeking professional medical advice. The App does not replace professional diagnosis or treatment.
3 Eligibility & account
- You must be at least 18 years old to create an account.
- You are responsible for all activity that occurs under your credentials and for keeping them confidential.
4 Licence to use the App
Oto grants you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms. We may modify, suspend or discontinue the App (in whole or part) for maintenance, security or legal reasons without liability.
5 Fees & subscriptions
- Access to locked content requires an Oto subscription. Up-to-date prices are displayed at checkout and may vary by currency.
- For self-pay consumers, all payments (and any indirect taxes) are processed by Apple App Store or Google Play.
- The Oto subscription is not available to US residents; US patients receive access through their clinic at no personal cost.
- Subscriptions renew automatically unless cancelled. Fees already paid are non-refundable except where local consumer law says otherwise.
6 Privacy & data protection
- We comply with the UK GDPR and, where applicable, the EU GDPR.
- Oto Health Inc. signs a HIPAA Business Associate Agreement (BAA) with every US clinic. Patient health information is handled in accordance with that BAA and our Privacy Policy.
- Where data are transferred from the UK/EU to the US, standard contractual clauses or an equivalent safeguard apply.
7 Third-party services
The App may interface with third-party applications, devices or clinic portals. Oto does not control and is not responsible for any third-party content, terms or privacy practices.
8 Updates to these Terms
We may amend these Terms from time to time. Material changes will be notified in-app or by email. Continued use of the App after the effective date constitutes acceptance of the updated Terms.
9 Termination
- Either party may terminate this agreement for convenience on 30 days’ written notice. Subscription fees already paid remain non-refundable.
- We may terminate immediately if you materially breach these Terms.
- Upon termination, your licence to use the App ends and we may delete or anonymise your data as described in the Privacy Policy.
10 Force Majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, epidemics, strikes, internet outages or government action.
11 Liability & indemnity
- Our total aggregate liability to you is limited to the subscription fees paid by (or attributable to) you in the preceding 12 months.
- Nothing limits liability for death or personal injury caused by negligence, fraud or any liability that cannot legally be limited.
- You agree to indemnify us against losses arising from your misuse of the App or infringement of third-party rights.
- Any claim must be brought within 12 months of the cause of action.
12 Governing law & dispute resolution
- Informal resolution – Contact us first at hello@joinoto.com; we aim to resolve complaints within 30 days.
- Consumers & patients outside the US – These Terms are governed by English law and the courts of England & Wales have exclusive jurisdiction.
- US clinic patients – Disputes are subject to binding arbitration under JAMS Rules in Delaware. Class-action waivers apply.
